Pot Brownie

NORTH NAPLES, Fla.- A Naples man is facing a felony charge for possession of a pot brownie.
Collier County deputies pulled Miles Johnson, 21, over for a broken tail light and that’s when reports show they discovered the pot brownie in his center console.
“I don’t think anyone has any idea it could be that serious,” said Criminal Defense Attorney Joshua Faett.
Johnson was arrested for possessing 163 grams of marijuana not because that’s how much the brownie contained, but because under the law, if mixed with other substances, the entire density of the product is measured.
“Realistically, if they test the brownie and it’s positive, I think they can charge him with the 163 grams,” said Faett.
According to reports, the brownie tested positive for marijuana at the scene. It will undergo lab testing to measure how much THC is in it.
The case will go to the State Attorney’s Office where prosecutors will decide how to move forward with the charges.
“I’d find it hard to believe they would go forward with a felony charge,” said Faett.
